ADDITIONAL DUTY OF THE POLICE: (PRLA-3/09)

A Shopkeeper closed his shop earlier to visit his uncle at his house, situated in the same town. He hired a Taxi & went to his uncle’s house along with his younger brother, a student of 0-level. They met their uncle & asked about his Health. He was seriously ill, looked very weak & had recovered a little. Hetook some cash with him from his shop, which he wanted to give to his unclefor better treatment, so as to recover quickly. His uncle didn’t accept paymenas he was a very sensitive person, who never took help from others. Hethanked his nephew & told that he didn’t need at present & would definitelytake from him, when needed. walking to their home on the hope that they would get a taxi soon. It was an early evening & the Local Police were ontheir routine round of the area, who stopped them & enquired about them.They told the Police the Truth. The Police took their Body-Search & foundNothing. The Police took them to their Police Station & presented them beforethe Police Station Officer, who ordered for their Body Search again. ThePolice Officer was delighted to see cash amount of 5000 bucks with them.They left the uncle’s house for their home. They couldn’t hire a Taxi, as it was not available, so they started walking to get a taxi for back to home.The Police Officer ordered to arrest them with a Charge of: “ Doubtful Wandering in a Sensitive Area” & locked them up.The Accused, the shopkeeper from the Police Lock-up told us:

“The Police Officer had seen Cash in my pocket. He won’t release us,until I pay him all the cash. I talked to the Police-Constables & they also confirmed me that this was the only way to get out of here. He added. I had also requested them to let my younger brother go, as he’s a student & his O-level Annual Exam will be started tomorrow. If he didn’t go, it will ruin his future. My shop may be closed, but my brother should be released at least, as he’s innocent. The Police Lock-up will ruin his future-career. I also had ‘no fault’ except to carry cash to help my old-age uncle in his severe illness. How can I hand over them ‘My Hard-
earned money’ so easily. This I can’t afford. Whatever be the Consequences ?

The Accused was right, if he didn’t hand over the Entire amount to the Police Officer, he would charge them with more Crimes. Probably, Police would Falsely Recover ‘ The Narcotics ’ from them. They were presented before theCourt next morning, which had sent them to the Prison, on the Basis of the Evidence Provided & Police Investigation.

OBSERVATIONS:

* To maintain the Law & Order, Security & Protection of the Public-Life
& Property, Respect & Dignity of the General Public etc;

*Where the Poor, Powerless & Ignorant People will get Justice for
themselves & their Families, when the Law enforcing Agencies Target them?

*Why mostly ‘The Courts’ follow & trust the ‘Law Enforcing Agencies’ -Reports &
Findings’ without their own verification & investigation ?

*Is the Additional Duty more important than the Actual Responsibilities Assigned
initially ?

*Is there Any 'Check & Balance-System' for their ‘Organized State Terrorism’?

*Or They have a Free Hand to go anywhere for Cruelty, Brutality, & take Law in
their own hands & Perform, Legally-Protected & Rewarded Special-Tasks of
the Law Enforcing Agencies?

Which is really , The Specially Assigned - Additional Duty of The Police.
